Every caller is told it is a digital assistant

At the start of every call, fonea says that it is a digital assistant. That disclosure cannot be turned off, so nobody hangs up believing they spoke to a person at 11pm. fonea also only answers calls, it never places them: no autodialing, no prerecorded outbound campaigns, no call lists, which is the activity the TCPA is written around.

Recording is a switch you control, and the rule is local

Storing call recordings is a checkbox in your dashboard settings, with a master switch for the business and a second switch per assistant, so you can record the day line and not the after-hours one. Recording happens only when both are on, and both are on by default, so turning it off is a deliberate click rather than a support request. It stops the audio being stored; transcripts and summaries are separate mechanisms and keep working. That switch matters in the US because recording consent is state law: most states require one party to consent, while California, Florida, Illinois, Pennsylvania, Washington and several others require every party on the line. Which rule applies to your calls, including the ones that cross a state line, is yours to determine.

No voiceprints, no biometric identifiers

fonea does not build a voice profile and does not identify callers by their voice. Calls are transcribed and the transcripts encrypted, and no biometric identifier is created or stored at any point. That is a design decision rather than a setting, and it is worth knowing if you do business in Illinois, whose biometric privacy law (BIPA) is written around exactly that kind of identifier.

Encrypted, and kept only as long as you say

Transcripts are encrypted in transit and at rest and deleted on the schedule you set, so a caller’s details do not sit in a system by default forever. That retention control is the practical part of answering a California resident who exercises their access or deletion rights under the CCPA and CPRA.
